- Introduction and Agreement
This is a legal agreement between you (we call you the “Client”) and us (we call ourselves the “Company”). By using our website design and development services, you agree to these rules. If you do not agree, please do not use our services. - What We Do
We design and build websites for you. “Design” means how your website looks, and “Development” means how it works online. - Payment and Refunds
- Payment: You agree to pay us the price we have agreed upon.
- Payment Terms: Please make your payments by the due dates we agree on.
- Refunds: We may give back money only in certain cases. A refund means returning money you have already paid. If you cancel after we’ve started working, you might not get all your money back.
- Your Responsibilities
- You must give us the information, pictures, text, and other materials we need to build your website.
- You promise that you have the right to use everything you send us (this means you own it or have permission).
- Intellectual Property
- Intellectual Property means creative work like designs, code, and artwork.
- We keep the rights to our original ideas and work. When you pay us, you get a license (a legal permission) to use the final website design.
- Some items (like special fonts or stock photos) might belong to someone else. We will tell you if that is the case.
- Privacy and Confidentiality
- We will keep your private information safe.
- Confidentiality means we will not share your personal or business information with others without your permission.
- We follow laws like the California Online Privacy Protection Act (CalOPPA) to help protect your privacy. Please see our Privacy Policy for more details.
- California Residents’ Privacy Rights
If you live in California, you have extra rights under the California Consumer Privacy Act (CCPA). This means:
- You have the right to know what personal information we collect about you.
- You have the right to ask us to delete your personal information.
- You have the right to stop us from selling your information (and we do not sell your information).
To exercise these rights, please contact us using the information in Section 16. This section is here to follow California law.
- Limitation of Liability
- We work hard to do our best, but sometimes things might go wrong.
- Limitation of Liability means that if something goes wrong that isn’t our fault, you cannot make us pay for big losses (like lost profits or other indirect damages).
- Some of these limits may not apply if California law gives you extra protection.
- Warranty Disclaimer
- We do not promise that our services will always be perfect or error-free.
- A Disclaimer means we are telling you in advance that we cannot guarantee perfect results. We will fix problems when we can, but we are not legally responsible for every mistake.
- Indemnification
- You agree to protect us if any legal problems come up because of the things you gave us (like content you didn’t have the right to share).
- Indemnification means you will cover any legal costs if someone sues us because of your actions.
- Termination
- Either you or we can end this agreement. If you cancel before we finish our work, you might not get a full refund.
- We can also stop our work if you do not follow these rules.
- Dispute Resolution
- If there is a disagreement between us, we will try to solve it by talking first.
- If we cannot agree, any legal issues will be handled in California courts.
- If you are a California resident, you may have rights that cannot be waived by this agreement.
- Governing Law
- These Terms are governed by the laws of the State of California. This means that California law will be used to solve any problems.
- However, if you are a California resident, certain parts of these Terms may not apply as strictly because California law gives you extra rights.
- Changes to These Terms
- We may update these Terms from time to time.
- We will let you know if there are big changes.
- By continuing to use our services, you agree to the updated Terms.
- Miscellaneous
- If any part of these Terms is found to be illegal or not allowed, the rest will still be in effect.
- These Terms are the whole agreement between you and us about our services. No other promises or agreements are part of this deal.
